For consultation - Review of the Timber Utilisation and Marketing Act 1987

Comments are being sought from interested stakeholders on the Timber Utilisation and Marketing Act 1987 (TUMA), as part of a review being undertaken by the Queensland Government.

An Issues Paper has been developed to provide an opportunity for key stakeholders and interested parties to submit comment about the review. Submissions will inform the development of possible policy options for consideration by the Queensland Government regarding the future of TUMA .

Written responses may be subject to Freedom of Information requests. Submissions will be publicly available, on application, subject to a photocopy charge. If a submission is to be kept confidential and for the Review Panel´s use only, this should be stated in the submission.

Terms of Reference

Legislative Review of the Timber Utilisation and Marketing Act 1987

The Minister for Primary Industries, Fisheries and Rural and Regional Queensland has approved the review of the Act, with terms of reference as follows:

  1. To review the objectives and purposes of the Timber Utilisation and Marketing Act 1987.

  2. To review the statutory functions, and powers and responsibilities under TUMA and identify changes that are required.

  3. Without limiting the scope of the review, the process shall:

    1. identify the nature of the restrictions on competition in TUMA

    2. analyse the likely effect of any identified restriction on competition on the economy generally

    3. assess and balance the costs and benefits of the restriction

    4. consider alternative means, including non-legislative approaches, for achieving the objectives

    5. consider whether any activities under TUMA contravene the restrictive conduct rules of Part IV of the Trade Practices Act 1974 (Cwlth) and the Competition Policy Reform Act 1995 (Cwlth), and identify options available to the government to achieve compliance therewith.

Public benefit assessments are to be conducted for those options that contain restrictions on competition, including the existing legislation. For each ´change´ option identified the review shall assess whether the public benefit of the change from the status quo outweighs any detriment caused by the change. It will also provide an assessment for the ´without change´ option, that is, the status quo. Such assessments will be in accordance with approved Queensland Treasury methodology.

  1. To make recommendations to the Minister for Primary Industries, Fisheries and Rural and Regional Queensland after having engaged in a process of consultation with industry, relevant government departments and the community.
